Drive Safer Sunday is November 26

this year nearly 30 million passengers will travel in their cars for the thanksgiving holiday

Senator Warnock (D-GA) and Senator Capito (R-WV) introduced and passed a bipartisan resolution to designate the Sunday after Thanksgiving as DRIVE SAFER SUNDAY.  The Sunday after Thanksgiving is one of the busiest travel days of the year, and it’s also one of the deadliest.  We are thankful that Senator Warnock and Senator Capito introduced this resolution to help raise awareness about the importance of safe driving, especially during the holiday season.

In Georgia, there were 18 traffic crash deaths during the 2022 Thanksgiving holiday period. In addition to fatal crashes, there were nearly 600 traffic crashes statewide during this period, resulting in almost 300 injuries. From 2017 to 2021, 82 Georgians were killed in traffic crashes during the Thanksgiving holiday period and there was a total of 16,171 traffic crashes reported that resulted in 5,727 injuries.

“Since the Sunday after Thanksgiving is one of the most congested road traffic days of the year and the day our son, Cullum, was killed while driving back to college, we hope that Drive Safer Sunday will encourage extra focus on safe driving that day,” said Steve and Susan Owings, Co-Founders of Road Safe America and Institute for Safer Trucking board members. “We also hope that this safety focus will be carried on during the holiday season and all year around.”

This Bi-Partisan Resolution encourages:

1.       K-12 schools, colleges, teachers, and administrators to launch campus-wide educational campaigns to urge students to focus on safe driving;

2.       Trucking firms to alert employees to focus on safe driving the Sunday after Thanksgiving and publicize its importance on the Citizens Band Radio Service and at truck stops;

3.       Clergy to remind congregations to travel safely when attending services;

4.       Law enforcement to remind drivers and passengers to drive safely;

5.       Americans wear seat belts and educate themselves about highway safety.

First introduced in 2005, this resolution has historically been a bipartisan effort led by one of Georgia’s U.S. Senators. The effort was started by Steve and Susan Owings, board members of the Institute for Safer Trucking from Atlanta, whose son Cullum was tragically killed in a truck crash after returning to college from their family Thanksgiving in 2002. Since Cullum’s passing, Steve and Susan Owings have advocated for safer trucking and have worked with Georgia’s Congressional delegation to introduce this resolution. As a member of the U.S. Senate committee overseeing the nation’s transportation policy, transportation safety will always be a priority for Senator Warnock.

I noticed this morning with sadness that a young woman was killed on I-285 last night when she got out of her car. Police said the accident happened around 10 p.m. on I-285 NB between South Cobb Drive and Atlanta Road.  There is no mention of why she left her car to become a person-on-foot on I-285, which is, by the way, one of the deadliest freeways in the United States. Whatever the reason, your car breaks down, or you have a medical emergency, you have a flat tire, or whatever...do not get out of your car on a highway. Getting out of your car of a highway is also one of the deadliest things you can do, even if you stay in an emergency lane. It doesn’t matter, it is still dangerous. “You are better protected in the car than anywhere else,” said Cathleen Lewis, director of Public Affairs and Government Relations for the Northeast division of AAA.

I represent a Good Samaritan right now who saw a car on the side of the way, apparently, having car trouble. He stopped to help because he is a good person. Unfortunately, while he was on foot trying to help the people in the stalled car, a van hits him and catastrophically injures him. He survived, but has not been able to return to work since. I hate to tell people stop helping others, stop being a Good Samaritan, but being a Good Samaritan can get you killed.  Do not get out of your car on a highway or interstate. Remain in your car and call 911 or your roadside assistance. Wait in the car until they get there. There is no safe place to be on the outside of your car.  Stay in your car!

It is so dangerous out there on our Georgia roads. Stay safe!

Have you seen the new commercial made by GMC for its new Sierra and Yukon Danali pick-up trucks that features hands free driving? It shows a person sitting in the driver’s seat of the truck (I hesitate to call this person a “driver” because he is really not driving at all) with no hands (and not even a knee) on the steering wheel while the pick-up truck appears to be moving at a high rate of speed. Then the person sitting in the driver’s seat begins to clap to the beat of Queen’s famous rock song “We Will Rock You.” And all the passengers in the vehicle start clapping in unison with the beat and with the person sitting in the driver’s seat of the speeding truck while he never touches the steering wheel with his hands. It is scary to watch on TV. It is even scarier to think that someone next to you or behind you on the highway is doing this in a vehicle while you attempt to drive as carefully as possible to arrive at your destination safely. Welcome to the world of hands free driving!

I ask whether you are willing to take the risk of hands free driving because using this “autopilot” feature on some new cars and trucks may result in some horrible consequences, including criminal charges for vehicular homicide.  This is what happened in Los Angeles recently when a person using a Tesla’s autopilot feature (notice I didn’t call him a “driver”) was charged with vehicular manslaughter with gross negligence for the deaths of two people who were killed when the auto-driven Tesla slammed into their Honda Civic, killing them both.  The National Highway Traffic Safety Administration (NHTSA) confirmed the auto-pilot feature was on at the time of the collision. The charges against the defendant appear to mark the first time a driver in the United States was prosecuted for a felony while using semi-automated driving technology. The families of the two decedents have filed wrongful death suits, but it is unclear whether Tesla was included as a defendant for products liability.

Michael Brooks, the chief operating officer at the Center for Auto Safety, a nonprofit advocacy group that focuses on the U.S. automotive industry, said he hopes Tesla drivers and owners see this case and understand that Autopilot has limitations. “It will not drive them from any point A to any point B always safely, and they need to be responsible for the actions of the vehicle,” Brooks said.

Every day as I travel down Edgewood Avenue in Downtown Atlanta in the middle of Georgia State University, some pedestrian, without fail, decides to take a risk and walk out in front of either my car or another car as I watch. The only time this doesn’t happen is when Georgia State is on Spring Break. It is a stressful trip, knowing that in addition to the numerous cars all around me that I have to be aware of, I have to be ready to slam my breaks in a nanosecond to avoid hitting a pedestrian walking out in front of my car when I have the right-of-way. I am aware of the plentiful crosswalks available for pedestrian use, but they are mostly ignored.  I am talking about students who ignore the crossing signals and walk across a street either not in a crosswalk at all, or in a crosswalk but cross when the signal is telling them to stop.  This typical daily occurrence with pedestrians has me thinking about just exactly what are the laws in Georgia pertaining to pedestrians? Is it just me or are the pedestrian signals getting more complicated?  What do they actually mean?  When does a pedestrian have the right-of-way to cross the street? Can a driver of a vehicle just mow down a pedestrian if the pedestrian is not in the crosswalk?  How about if the pedestrian is in the crosswalk but the flashing hand has started with a stopwatch ticking down, telling the pedstrian how many seconds he or she has to cross the street before the signal turns?  Is a pedestrian required to know how fast they can walk and how many seconds they typically take to cross a street?  Does it depend on how many lanes the street is?  And whether there is a headwind or tailwind? My drive today has me thinking about all of this.  Hmmm….

First, we can easily find the Georgia Rules of the Road as they pertain to pedestrians on the Georgia Highway Safety website. The Official Code of Georgia provides:  § 40-6-91. Right of Way in Crosswalks: 

(a) The driver of a vehicle shall stop and remain stopped to allow a pedestrian to cross the roadway within a crosswalk when the pedestrian is upon the half of the roadway upon which the vehicle is traveling, or when the pedestrian is approaching and is within one lane of the half of the roadway on which the vehicle is traveling or onto which it is turning. For the purposes of this subsection, “half of the roadway” means all traffic lanes carrying traffic in one direction of travel.

It’s only a matter of time before you or a loved one is injured by one of these nuisances that are so prevalent on Atlanta city and county streets these days.  Or it’s just a matter of time before you damage your car from driving over one of them.  The ubiquitous metal plate. Who thought these were a good idea in the first place?  The metal plates in the photographs above are currently on my street, Oakdale Road in unincorporated DeKalb County. These two metal plates have been there for months.  And notice there is really nothing hold them in place other than the mere weight of the things and gravity.  But a truck that ways 60,000 pounds loaded, or an SUV that weighs 10,000 pounds or even a small car that weighs 6,000 pounds going 35 m.p.h. can easily move these plates when they are not pinned down.  Once moved, they become a potentially fatal hazard to the motoring public. Imagine coming upon this monster (see photograph below) as you mind your own business driving down the road. Once your car ran over it, you and your car wouldn’t stand a chance.  The weight of your car would cause the metal plate to flip and your car would fall into the sinkhole below. It is doubtful you could escape without serious bodily injury.  The photographs below show several metal plates that are clearly not pinned down or held down in any way whatsoever.  Car and truck traffic have obviously shifted them, so that the next unknowing driver, potentially YOU, could be swallowed by the hole they are supposed to be covering.  I am confident this is not an isolated situation;  my guess is that you have seen the frightening scenario below multiple times.

There are actually requirements for the way these metal road plates are required to be placed on the roadway.  For example, steel plates must be fixed in place to avoid movement.  In addition to being firmly in contact with the pavement, they should be either pinned, recessed into the pavement, or secured with asphalt wedges around the perimeter. Pinning into the pavement involves driving pins into the pavements along the edges of the steel plates to prevent movement. Recessing involves cutting out the area where the steel plate will be placed.  If these are the mandatory requirements for use of these monsters, why are they so seldom pinned down or recessed?  As a member of the motoring public, you are entitled to assume these plates have been put down and affixed to the street properly so that they are safe for you to drive over. The law does not require you to drive around them in an effort to avoid them.

Remember the “Pothole Posse” formed by then City of Atlanta Mayor Shirley Franklin?  It seemed to make progress for awhile, but after the initial excitement about bringing back safe streets, we are right back where we were with our streets littered and cluttered with these metal plates. Recently, in New York, such metal road plates may have played a role in a fatal crash that killed six people.

policecarPolice chases seem to be extremely prevalent in our everyday goings on lately. Last night I watched the famous “slow speed chase” of O.J. Simpson when he fled the Los Angeles Police Department back in 1994  instead of turning himself in as agreed upon following the murders of his wife Nicole and her friend. The mini-series drama currently being shown on the FX Network about “The Juice” reminded me of the night that slow speed chase happened as my husband and I watched in horror and amazement in 1994 as my husband put together the crib for the child we were expecting in August of that year.  Then I woke up this morning to a text alert from the AJC that there had been another police chase here in Atlanta this morning. This morning’s chase, which was near the Douglas-Cobb county line, near Six Flags Over Georgia,  was of two people suspected of having robbed a convenience store of cash and cigarettes.  This police chase ended with the suspects’ car crashing into a utility trailer. The police caught one suspect and the other suspect got away. Apparently, no one was injured in the police chase this morning.  Thank Goodness, I might add.  In San Francisco, California on Sunday, February 7, three people were killed in a police chase after police chased a car that had been seen “doing circles” in the middle of a city street.

We were not so fortunate, however, with regard to two other police chases that occurred a week ago. In Gwinnett County, a totally innocent older couple was killed in a police chase in which the Johns Creek Police Department started a high speed chase of a vehicle for “equipment violation” because it had multiple antennae.  This chase lasted for 4 miles and reportedly reached speeds of 83 m.p.h.  The couple was driving home after celebrating the 78th birthday of one of them.  The suspect’s car crashed into the innocent couple’s car and killed them. No, the police car didn’t hit the couple’s car, but in the world of proximate cause, “but for” the police car and the police chase this lovely couple would be still be alive.  Tragically, and almost unbelievably, the next day a totally innocent grandmother who was taking her precious two grandchildren to church on Sunday morning,  was killed, along with those precious two grandchildren, in a high speed police chase.  This time it was the College Park Police Department chasing a vehicle driven by a suspect suspected to have stolen a vehicle. The chase lasted a purported 10 miles. Five innocent lives lost in the span of two days due to high speed police chases.

Think for just a minute how you would feel if one of your loved ones were killed because of a high speed chase.  How would you feel?  Would you think the high speed police chase had been unnecessary?  Not worth the risk?  Put yourself in the shoes of those grieving family members for a minute.

The Georgia State Patrol and and various National Databanks, including the National Safety Council, have for years kept the morbid statistics of how many people die during any given Holiday weekend. I have blogged about this in the past and try to keep tabs on whether Georgia highways are getting safer. Here are 5 things to know about traffic safety from the 2015 Labor Day:

  1.  In Georgia this past weekend 14 people lost their lives in traffic incidents as reported by the Georgia State Patrol. Just for comparison’s sake, there were only two traffic fatalities in Connecticut. In Kentucky there were nine.
  2. The National Safety Council estimated there would be 395 traffic fatalities in the United States this Labor Day. Final National numbers are not yet in as some polls include any fatalities up to Tuesday morning.
